Tripspeaker (Application) is a mobile application where Guides share their travel experiences with Travelers (Users) by uploading voice recordings, video recordings, routes, texts, and photos. All rights of the Application belong to Tripstyle Tourism Guidance Information Technology Trade Ltd. Co., and this Text regulates the terms and conditions related to Users who wish to use the Tripspeaker mobile application, benefit from the services provided, and access the offered content.

Definitions in this Text:

• Guide: The person who uploads their travel experiences to Tripspeaker in permitted formats.

• Traveler/User: The person who purchases the content uploaded by the Guide to benefit from their travel experiences.

• Application: The Tripspeaker Mobile Application that brings Guides and Travelers together on the same platform.

• Trip: The collection of content uploaded by a Guide about a single location on Tripspeaker.

• Tripstyle Tourism: Refers to Tripstyle Tourism Guidance Information Technology Trade Ltd. Co.

• Text: Refers to the Tripspeaker User Terms and Conditions.

Rights and Obligations

When registering to the Tripspeaker application as a "Traveler," the Tripspeaker User Terms and Conditions set forth in this Text are deemed accepted, and all provisions come into force with the membership. A User who does not agree with these conditions should not register to the Application and should not access Tripspeaker services.

Accordingly:

• The User must create a membership account to use the Tripspeaker application. The information provided during registration must be real, accurate, up-to-date, and complete. The User must promptly update this information when necessary.

• A User must be at least 18 years old to create an account.

• The User acknowledges that they can only create one account, and it is exclusively for their own use. Transfer of the account or using someone else’s account is strictly prohibited.

• By accepting the User Terms and Conditions, the User declares and undertakes that they are authorized to access and use Tripspeaker and assume all responsibility for accessing, selecting, and using the services.

• The User is solely responsible for all activities carried out through their Tripspeaker account, including actions taken by third parties using the account without permission. The User is also responsible for maintaining the confidentiality and security of their username and password.

• Membership in Tripspeaker is free. However, Users may only use the uploaded content by paying the fee set by the Guide and purchasing the content.

• Any User content uploaded to Tripspeaker that contains insults, harassment, threats, racist, sexist, separatist expressions, criminal elements, or misleading/false information is strictly prohibited. If User content violates this clause, Tripstyle Tourism may suspend or terminate the account and seek compensation for damages, including amounts paid to third parties.

• Users are prohibited from sharing their personal contact information (phone number, email address, social media handles, etc.) through the Application or attempting to obtain others’ contact details or personal data.

• Unauthorized interventions in the Application are strictly prohibited, including but not limited to:

  • Accessing restricted areas of the Application (including content storage), Tripspeaker’s computer systems, or service providers’ distribution systems.

  • Disabling or bypassing security features.

  • Copying, modifying, reverse engineering, or attempting to discover source code or content.

  • Using automated systems (bots, spiders, scrapers, etc.) to access or interact with the Application outside the provided API.

  • Sending viruses, spam, fake identifiers, or otherwise interfering with service availability.

• The User cannot modify, adapt, or copy Tripspeaker software or content, nor create misleading impressions suggesting affiliation with Tripspeaker or Tripstyle Tourism.

• Tripstyle Tourism may update these Terms at its discretion. Updated Terms will take effect on the date of publication unless stated otherwise. By continuing to use Tripspeaker, the User accepts the updated Terms.

• The User must comply with all applicable laws and regulations, including copyright laws, when using Tripspeaker. Content uploaded by Guides belongs to the Guide and Tripstyle Tourism under the Guide Terms, and Users may only access such content for personal use within the purpose of Tripspeaker. Users cannot modify, copy, store, share, or misuse the content. Violations may lead to account suspension and liability for damages.

• All rights and licenses over the Application and software belong to Tripstyle Tourism. Membership does not grant the User any license.

• Comments and ratings shared by Users are public. Personal data required for registration (such as identity details and passwords) are not shared with third parties. Details are provided in the Privacy Notice.

• Tripstyle Tourism is not liable for interruptions in access caused by internet providers or technical issues beyond its control but will aim to resolve them promptly.

• Tripspeaker may display ads or promotions, the format and scope of which may change without notice.

• User interactions with other Users or Guides, whether online or offline, are entirely the User’s responsibility. Tripstyle Tourism does not assume liability for such interactions.

• Access to the Application requires compatible devices and network connectivity, which are the User’s responsibility.

• The User agrees not to misuse the Tripspeaker brand, not to hinder other Users’ use of the service, and to report violations immediately.

• Tripstyle Tourism does not own Users’ information or content but may process data per the Privacy Notice.

• Breach of these obligations may result in account suspension or termination, without prejudice to Tripstyle Tourism’s right to claim damages.

Pricing and Payment

• Tripspeaker services are available by paying the fee set for each Trip.

• Tripstyle Tourism sets a Minimum/Maximum Price Table, but the final price within that range is determined by the Guide.

• Payments can be made via bank card, credit card, or virtual card. Purchased content remains available to the User indefinitely unless removed due to legal or policy reasons.

• Tripstyle Tourism reserves the right to impose, remove, or change charges at its sole discretion. Price changes do not affect past purchases.

Termination

• Tripstyle Tourism reserves the right to remove the Tripspeaker application without prior notice and bears no liability for doing so.

• Users may delete their account and exit the application at any time.

• Termination of an account ends access to Tripspeaker services, though previously entered data may remain for non-identifiable use.

• Breach of these Terms may result in immediate account closure at Tripstyle Tourism’s discretion.

Copyrights

• Tripspeaker is protected under intellectual property laws, and all rights and licenses belong to Tripstyle Tourism.

• Users cannot alter, reverse engineer, or replicate Tripspeaker software unless expressly permitted under an open-source license.

• The Tripspeaker brand and logo are trademarks of Tripstyle Tourism and cannot be used without written permission.

• Users have no ownership over content uploaded by Guides and may only access it after purchase for personal use.

Right of Withdrawal

Under Turkish Law No. 6502 and the Regulation on Distance Contracts, services instantly performed or digital goods instantly delivered online are exceptions to the right of withdrawal. Therefore, Users cannot exercise a right of withdrawal for content purchased on Tripspeaker.

Disclaimer of Warranties

• Tripspeaker services and content are provided “as is” and “as available.”

• Tripstyle Tourism makes no warranties regarding accuracy, availability, reliability, or fitness for purpose.

• Users assume all risks associated with using the Application.

Dispute Resolution

• Users may contact Tripstyle Tourism’s support team for issues experienced in Tripspeaker.

• If unresolved, disputes will be governed and interpreted under the laws of the Republic of Turkey, and the Courts and Enforcement Offices of Istanbul shall have jurisdiction.
